Welcome to The Whisketiers. By accessing our website and placing an order, you agree to the following Terms of Service. Please read them carefully before making a purchase.
1. General Terms
1.1. These Terms of Service apply to all purchases, orders, and transactions made through The Whisketiers website, social media platforms, WhatsApp, or any authorized sales channel within India.
1.2. By placing an order with The Whisketiers (“we”, or “us”), you agree to be bound by these Terms of Service, along with our Shipping Policy, Return & Refund Policy, and Privacy Policy.
1.3. The Whisketiers reserves the right to update, modify, or revise these Terms of Service at any time without prior notice. Continued use of our website following any changes constitutes acceptance of those changes.
2. Orders & Confirmations
2.1. Orders may be placed through:

- Instagram/WhatsApp
- Authorized delivery partners
- Customer support channels
2.2. All orders are subject to availability and acceptance by The Whisketiers.
2.3. The Whisketiers reserves the right to refuse or cancel any order due to:
product unavailability,
incorrect pricing,
incomplete customer information,
suspected fraudulent activity,
or any other lawful reason.
2.4. Once an order has entered preparation or dispatch, cancellations or modifications may not be possible.
2.5. For customized, bulk, or corporate gifting orders, additional processing timelines and approval terms may apply.
3. Pricing & Payments
3.1. All prices listed on our website are in Indian Rupees (INR) and inclusive of applicable GST unless otherwise stated.
3.2. Delivery charges, packaging fees, and handling charges may apply separately depending on the order value and delivery location.
3.3. Prices and product availability are subject to change without prior notice.
3.4. Payments must be completed at the time of order placement through approved payment methods including:
- Credit/Debit Cards
- UPI
- Net Banking
- Wallets
- Shopify Payments
- COD (where applicable)
4. Product Availability
4.1. All products displayed on our website are subject to availability.
4.2. As our products are handcrafted and freshly prepared, certain products may occasionally be unavailable or limited in quantity.
4.3. In case of product unavailability, The Whisketiers reserves the right to substitute an item with another product of equal or greater value while maintaining overall product quality and presentation.
4.4. Product packaging and presentation may vary slightly from displayed images.
5. Shipping & Delivery
5.1. Customers are responsible for providing accurate delivery details including recipient name, address, contact number, and delivery instructions.
5.2. The Whisketiers shall not be responsible for failed or delayed deliveries caused by:
- incorrect addresses,
- recipient unavailability,
- inaccessible delivery locations,
- weather conditions,
- courier delays,
- festivals,
- strikes,
- or circumstances beyond our control.
5.3. Same-day delivery is available only for select pincodes and subject to order cut-off timings.
5.4. Delivery timelines provided are estimates and may vary during festive or high-demand periods.
5.5. Risk of loss or damage transfers to the customer upon successful delivery.
6. Product Care & Storage
6.1. Our chocolates, desserts, and baked products are perishable and should be stored as instructed on the packaging.
6.2. Products should be kept in a cool and dry place away from direct sunlight and heat.
6.3. Slight melting, softening, or variation in appearance may occur due to weather conditions or the handmade nature of our products.
7. Complaints & Claims
7.1. If you receive a damaged, incorrect, or incomplete order, please contact us within 24 hours of delivery.
7.2. Claims must include:
- Order Number
- Description of the issue
- Supporting photographs/videos
7.3. After reviewing the claim, The Whisketiers may provide:
- replacement,
- reshipment,
- or store credit, at its sole discretion.
7.4. Claims raised after 24 hours of delivery may not be eligible for review.
8. Returns & Refunds
8.1. Due to the perishable nature of our products, returns are generally not accepted.
8.2. Approved refunds, replacements, or compensations will be provided only in the form of store credit unless otherwise determined by The Whisketiers.
8.3. No monetary refunds shall be provided for issues arising from:
- incorrect shipping information,
- recipient unavailability,
- delayed acceptance,
- or improper storage after delivery.
9. Intellectual Property
9.1. All content on The Whisketiers website including:
- logos,
- product names,
- packaging designs,
- photographs,
- videos,
- graphics,
- and written content are the intellectual property of The Whisketiers and may not be copied, reproduced, or used without prior written permission.
10. Customer Communication
10.1. By placing an order, you consent to receive:
- order updates,
- delivery notifications,
- customer support communication,
- WhatsApp updates,
- promotional messages,
- and marketing emails from The Whisketiers.
10.2. Customers may opt out of promotional communication at any time.
11. Limitation of Liability
11.1. The Whisketiers shall not be liable for any indirect, incidental, special, or consequential damages arising from:
- product consumption,
- delayed deliveries,
- courier disruptions,
- or website usage.
11.2. Our total liability, if any, shall not exceed the value of the purchased product.
Governing Law
These Terms of Service shall be governed and interpreted in accordance with the laws of India and the State of Maharashtra.
Any disputes arising shall be subject to the exclusive jurisdiction of courts located in Mumbai, Maharashtra.
No Resale
Products purchased from The Whisketiers are intended solely for personal consumption and gifting purposes and may not be resold without prior written consent.
